Construction Reform


 
On June 30, 2011, Governor Kasich signed House Bill 153 which included the first changes in the state's method of performing public construction in over 134 years. These changes, collectively known as Ohio Construction Reform or OCR, substantially alters how public improvement projects are completed and allows for the use of alternative construction delivery methods, such as General Contracting, Construction Manager at Risk and Design Build. Each public authority now has the option to select the best delivery method for their specific project, including the existing multiple prime contacting method for construction.
 
The use of a single contractor holder who has overall responsibility for the completion of a project offers the project owner the opportunity to reduce both the cost of the project and the time necessary for project completion. The public owner is no longer responsible for coordinating the activities of all trade contractors on site with the new delivery options. Under CM at Risk and Design-Build methods, there can also be a pre-negotiated guaranteed maximum price. All of the alternative delivery method options have been used extensively over the past half century within the private sector as well as in the public sector outside Ohio.
 
In order for Ohio Construction Reform to become effective and fully implemented, OFCC, inconjunction with the Ohio Attorney General's Office and The Ohio State University, developed and adopted several required administrative rules, as well as professional design agreements, construction contracts and other related forms and documents. In addition, OFCC hosted training events to explain the new laws and procedures with more than 1,000 people in attendance at seven locations across the state.
