Allocation Form Now Available for Public Owners
A new state law that recently went into effect, Ohio Revised Code section 9.239, creates new responsibilities for public building owners that have construction projects that improve energy efficiency.
Effective April 12, 2021, public owners are now required to allocate a federal tax deduction, if merited, to the designer responsible for designing energy efficient commercial property in public buildings.
OFCC has created a sample form (see 179D Allocation Form tab) that public owners may use for gathering the necessary information to evaluate these tax deduction requests. Use of this OFCC form is required only on OFCC-administered projects, but is available for use by any public owner.
Completed forms must be sent to the public building owner designee and OFCC at 179D@ofcc.ohio.gov. The forms must be completed in their entirety to be accepted. Non-completed forms will be deemed as not submitted.
